RULES


IV. ARCHITECTURAL CONTROL AND APPLICATION PROCESS

A. The homeowner shall submit in writing to the Homeowners Architectural Advisory Committee (HOAAC) a detailed statement of the proposed changes(s) or improvements(s) to the Lot or to the dwelling, including, but not limited to doors, windows and sliding glass doors.

B. No building, fence, wall or other structure shall be commenced, erected or maintained upon the property, nor shall any exterior addition to or change or alteration therein be made until the plans and specifications showing the nature, kind, shape, height, materials and location of the same shall have been submitted to and approved, in writing, as to harmony of external design and location in relation to surrounding structures and topography (see Article V of the Declaration).

C. All plans and specifications set forth will then be reviewed by the HOAAC.

D. Any application which does not comply with the requirements of the application shall be denied.

E. No work shall commence until approval has been received in writing from the HOAAC.

PROCEDURE FOR PROCESSING APPLICATIONS

B. All requests shall be marked with the date received by Trenton Property Services, Inc. (TPSI). All applications shall be acted upon pursuant to Article V of the Declaration by the HOAAC within sixty (60) days. If a delay is expected, the homeowner shall be notified via first class mail that the request is denied but deemed resubmitted as of the date of the notice. The homeowner may not begin construction until provided with an approval.

C. All homeowners shall be promptly notified in writing after a decision I action is made by the HOAAC. Said notification shall state the nature of the request, the reason for the findings of the HOAAC and whether said application has been approved or denied.

D. No verbal requests shall be accepted.

E. An approval by the HOAAC does NOT constitute an approval by the Harford County Planning and Zoning. The appropriate building permit must be obtained from the County after approval from the HOAAC has been received. All alterations or improvements to the exterior of a dwelling or on a Lot shall meet all applicable county, stated and Federal Codes, Laws and Standards.

VIOLATIONS OF RULES AND REGULATIONS

The HOAAC may make recommendations to the Board of Directors upon notice from the Property Manager or person of violations, or possible violations of the Rules and Regulations. Any modification, alteration or addition to the Lot or to the exterior of the dwelling without prior written approval of the HOAAC shall constitute a violation.

For failure to comply, fines will be assessed in accordance with those procedures and schedules established by the Board of Directors in Section III, Penalties, of the Rules and Regulations.
